MSC Order List: December 21, 2009

On December 21, 2009, the Michigan Supreme Court denied 116 applications for leave and/or complaints, 15 motions for reconsideration, and two motions for miscellaneous relief.  The Court also held Cottrill v. Senter, Case No. 139677, in abeyance pending a decision in McCormick v. Carrier, Case No. 136738 (see our previous post here); remanded Swanson v. Port Huron Hospital, Case No. 139611, for reconsideration in light of the Court’s decision in Bush v. Shabahang, 484 Mich 156 (2009) (see our previous post here); remanded People v. Banks, Case No. 138909, for consideration under the standard for direct appeals, because the defendant was deprived of his direct appeal as a result of constitutionally ineffective assistance of counsel; remanded Hanners v. Sankaran, Case No. 138702, for dismissal based on Kidder v. Ptacin, 284 Mich. App. 166 (2009) (see our post here); ordered the defendant’s former appellate counsel to file a supplemental brief in People v. Keller, Case No. 139133, to address why he failed to file an application for leave in the Michigan Court of Appeals; and ordered the defendant’s former appellate counsel to file a supplemental brief in People v. Goodman, Case No. 139076, to address whey he failed to file timely post-judgment motions and a timely application for leave in the Michigan Court of Appeals.
